Statewide Registry of Private Conservators, Guardians and Trustees
EFFECTIVE JULY 1, 2008, THE STATEWIDE REGISTRY OF CONSERVATORS, GUARDIANS AND TRUSTEES WAS REPLACED BY THE PROFESSIONAL FIDUCIARIES BUREAU ADMINISTERED BY THE DEPARTMENT OF CONSUMER AFFAIRS
The Professional Fiduciaries Bureau was created by the Professional Fiduciaries Act (Chapter 491 of the Statutes of 2006, as amended by Chapter 354 of the Statutes of 2007). The act is codified at sections 6500 through 6592 of the Business and Professions Code. The Bureau is charged with licensing and regulating professional fiduciaries, as defined by the act.
Subdivision (f) of section 6501 of the Business and Professions Code defines “professional fiduciary.” Subdivision (a) of section 6502 of the Business and Professions Code further provides that “Every person who is required to register with the Statewide Registry maintained by the Department of Justice under Chapter 13 (commencing with Section 2850) of Part 4 of Division 4 of the Probate Code prior to January 1, 2007, shall be required to obtain a license as a professional fiduciary under this chapter.”
The act prohibits a court from appointing a person to carry out the duties of a professional fiduciary on or after July 1, 2008, unless the person is licensed as a professional fiduciary by the Bureau. The act requires that all professional fiduciaries be licensed by January 1, 2009.
